The success of rent review negotiations depends upon the correct interpretation of specific lease terms and the analysis of comparable evidence. Faced with the threat of Arbitration or Court proceedings, many tenants and landlords feel under pressure to agree without proper consideration of the merits of their case.
Chartered Surveyors, London Clancy has specialist expertise in rent review and lease renewal matters and advise a wide variety of businesses on Landlord & Tenant issues, including arbitration and independent expert appointments. Our Chartered Surveyors have many years experience acting on behalf of commercial property landlords and tenants and regularly achieve significant financial benefits for their clients.
We are happy to work on a performance-related basis and will undertake an initial consultation free of charge. With our offices based in Basingstoke, Camberley, Southampton and Winchester, we have an in depth knowledge of the commercial property market throughout the region.
London Clancy’s team of RICS Registered Valuers regularly undertake formal valuations on behalf of banks, SIPP providers, property companies, investment companies and private individuals. We act in the capacity of external valuer in accordance with the Valuation Standards of the RICS.
Valuations can be undertaken for the following purposes:
• Portfolio appraisal
• Balance sheet
We deal with valuations of commercial properties of all sizes and complexities. We do not delegate valuations to junior staff. Our philosophy is centred on client service, providing fast, accurate and informed advice to ensure that the client can fully appreciate not only the headline valuation figure, but also the broader issues relevant to the valuation.
We have acted for most of the major banks, including Barclays, HSBC, NatWest/Royal Bank of Scotland, Clydesdale and Handelsbanken providing commercial property asset valuations and development appraisals for secured lending purposes.
Our experienced RICS Registered Valuers are able to provide “Red Book” valuations that fully comply with the RICS Valuation Standards.
Following the revaluation of all business premises by the Valuation Office in 2010 all companies have the opportunity to appeal their rateable value and reduce their rates payments.
The revaluation introduced new rules for appeals, transitional arrangements and small business relief.
Our rating service has been established for well over 25 years and comprehensively covers the rating appeal process. We act for commercial property occupiers and owners in dealing with rating issues from initial advice throughout the appeal process to the refund of rates and ensuring that the correct rates are paid following an appeal.
Our experienced team of rating surveyors provides a service that includes:
• Completing Forms of Return
• Property inspections
• Advice on whether an appeal is appropriate
• Completing and submitting appeals
• Negotiating with the Valuation Officer
• In the event of a negotiated settlement not being reached, presenting a case to the Valuation Tribunal.
• Appealing to the Lands Tribunal as appropriate against a Valuation Tribunal decision
• Verifying and overseeing the refund of rates and the adjustment for future rates payments
In addition to the above we deal with recommendations and interim appeals where a property is vacated, altered or demolished or where there is a “material change of circumstances” such as a temporary change to a locality, eg a disturbance from road works or building works or a permanent changes, eg where a new development affects the value of a property.
Our Rating surveyors are members of the RICS, IRRV or RSA and all work to the RICS Code of Practice for rating instructions.
